COMMUNITY E.P.E. SCAVENGER HUNT

PARTICIPANT AGREEMENT, ASSUMPTION OF RISK, RELEASE OF LIABILITY, INDEMNIFICATION, AND MEDIA RELEASE

Please read this document carefully before signing. By signing this Agreement, you acknowledge that you understand its contents and agree to be bound by its terms.

("Organizer," including its officers, directors, employees, volunteers, sponsors, community partners, agents, and representatives)

1. PURPOSE OF AGREEMENT

This Agreement is entered into as a condition of participation in the Community EPE Scavenger Hunt ("Event"). The Event may involve individuals and teams traveling to multiple locations, completing challenges, solving clues, taking photographs, interacting with community members, and engaging in activities that may occur in public, private, indoor, or outdoor environments.

The participant acknowledges that participation is entirely voluntary and that participation may involve risks that cannot be completely eliminated.

2. ASSUMPTION OF RISK

I understand and acknowledge that participation in the Event may expose me to known and unknown risks, hazards, and dangers, including but not limited to:

Physical Risks

  • Slips, trips, and falls

  • Muscle strains and sprains

  • Cuts, scrapes, bruises, and abrasions

  • Heat exhaustion, heat stroke, dehydration, or cold-related illness

  • Fatigue and overexertion

  • Exposure to uneven terrain or environmental hazards

Transportation Risks

  • Traveling by foot, bicycle, public transportation, or private vehicle

  • Vehicle accidents

  • Traffic-related injuries

  • Pedestrian accidents

  • Parking lot hazards

Environmental Risks

  • Adverse weather conditions

  • Lightning, wind, rain, snow, or extreme temperatures

  • Exposure to insects, animals, or allergens

  • Poor visibility or changing environmental conditions

Public Interaction Risks

  • Interaction with members of the public

  • Crowded areas

  • Misunderstandings or disputes with third parties

  • Actions or omissions of other participants

Property Risks

  • Theft, loss, or damage of personal property

  • Damage to electronic devices

  • Loss of valuables

I knowingly and voluntarily assume all risks associated with participation, whether foreseeable or unforeseeable.

3. PARTICIPANT RESPONSIBILITIES

As a condition of participation, I agree that I will:

Safety Requirements

  • Exercise reasonable judgment and caution at all times.

  • Follow all Event rules, instructions, and communications.

  • Maintain awareness of my surroundings.

  • Immediately report emergencies, injuries, or unsafe conditions.

Legal Compliance

  • Obey all local, state, and federal laws.

  • Respect all traffic laws and pedestrian regulations.

  • Obtain permission before entering private property.

  • Refrain from trespassing, vandalism, or disruptive conduct.

Conduct Requirements

  • Treat all participants, volunteers, sponsors, business owners, and members of the public respectfully.

  • Avoid harassment, discrimination, threatening behavior, or misconduct.

  • Refrain from any illegal activity.

  • Avoid reckless actions that could endanger others.

Prohibited Activities

Participants may not:

  • Enter restricted or prohibited areas.

  • Climb structures, fences, rooftops, or other unsafe locations.

  • Remove, damage, or alter property.

  • Consume illegal substances.

  • Operate a vehicle while impaired.

  • Engage in dangerous stunts or behavior to gain a competitive advantage.

The Organizer reserves the right to remove any participant from the Event for unsafe, disruptive, or inappropriate conduct.

4. MEDICAL FITNESS AND HEALTH REPRESENTATION

I certify that:

  • I am physically and mentally capable of participating in the Event.

  • I have no known condition that would make participation unreasonably dangerous.

  • I will monitor my own physical condition during the Event.

  • I will discontinue participation if I experience illness, injury, or distress.

I understand that the Organizer is not responsible for evaluating my fitness to participate.

5. EMERGENCY MEDICAL AUTHORIZATION

In the event of injury, illness, or emergency, I authorize the Organizer to seek emergency medical assistance on my behalf if I am unable to do so.

I understand and agree that:

  • Emergency medical services may not be immediately available.

  • The Organizer does not guarantee medical supervision.

  • Any medical expenses incurred are my sole responsibility.

  • The Organizer assumes no responsibility for medical treatment provided by third parties.

6. RELEASE OF LIABILITY

To the maximum extent permitted by law, I hereby release, waive, discharge, and covenant not to sue the Organizer, sponsors, community partners, venue owners, volunteers, officers, directors, employees, representatives, and agents from any and all claims, liabilities, demands, causes of action, damages, losses, costs, expenses, or attorney fees arising from or related to:

  • Personal injury;

  • Illness;

  • Disability;

  • Property damage;

  • Economic loss;

  • Emotional distress;

  • Death; or

  • Any other loss arising out of participation in the Event.

This release applies whether such claims arise from negligence or otherwise, except to the extent prohibited by applicable law or caused by gross negligence or intentional misconduct.

7. INDEMNIFICATION

I agree to defend, indemnify, and hold harmless the Organizer and all released parties from any claims, lawsuits, liabilities, damages, losses, judgments, costs, and expenses arising out of:

  • My actions or omissions;

  • My violation of Event rules;

  • My violation of applicable laws;

  • Damage caused by me to persons or property;

  • Claims brought by third parties resulting from my conduct.

8. PERSONAL PROPERTY

I understand that I am solely responsible for my personal belongings.

The Organizer shall not be responsible for:

  • Lost property;

  • Stolen property;

  • Damaged property;

  • Data loss from electronic devices;

  • Vehicle damage or theft.

Participants are encouraged to secure valuables and carry only necessary items.

9.PHOTOGRAPHY, VIDEO, AND MEDIA RELEASE

I grant the Organizer and its designees the irrevocable right to:

  • Photograph me;

  • Record video of me;

  • Record my voice;

  • Use my name, image, likeness, statements, and biographical information.

I authorize the use of such materials in:

  • Event promotions;

  • Community outreach;

  • Websites;

  • Social media platforms;

  • News releases;

  • Marketing materials;

  • Future Event advertising.

I understand that:

  • No compensation will be provided.

  • I waive any right to inspect or approve final materials.

  • The Organizer may use materials indefinitely unless prohibited by law.

10. DATA AND COMMUNICATION CONSENT

I understand that registration information may be collected and used for:

  • Event administration;

  • Participant communications;

  • Emergency notifications;

  • Event updates and announcements.

The Organizer will not intentionally disclose personal information except as necessary for Event operations or as required by law.

11. SEVERABILITY

If any provision of this Agreement is held invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

12. GOVERNING LAW

This Agreement shall be governed by and interpreted under the laws of the State of Kansas, without regard to conflict of law principles.

Any legal action relating to this Agreement shall be brought exclusively in the appropriate courts located within that jurisdiction.

13. ACKNOWLEDGMENT

By signing below, I acknowledge that:

  • I have carefully read this Agreement.

  • I understand its contents.

  • I understand that I am waiving certain legal rights.

  • I voluntarily agree to all terms and conditions.

  • I am at least 18 years of age or have obtained parental/guardian consent.

PARENT/GUARDIAN CONSENT FOR MINORS

(Required for participants under 18 years of age)

I am the parent or legal guardian of the minor identified below. I have read and understand this Agreement and consent to the minor's participation in the Event. On behalf of myself and the minor participant, I agree to all terms of this Agreement, including the assumption of risk, release of liability, indemnification, and media release provisions.
